Encontré este texto sobre lo que está haciendo Apple con la música, está en inglés, pero espero aporte al tema.

"What Amber explained was exactly what I’d feared: through the Apple Music subscription, which I had, Apple now deletes files from its users’ computers. When I signed up for Apple Music, iTunes evaluated my massive collection of Mp3s and WAV files, scanned Apple’s database for what it considered matches, then removed the original files from my internal hard drive. If Apple Music saw a file it didn’t recognize—which came up often, since I’m a freelance composer and have many music files that I created myself—it would then download it to Apple’s database, delete it from my hard drive, and serve it back to me when I wanted to listen, just like it would with my other music files it had deleted."

Aquí Apple asume incorrectamente que todo lo que tiene el consumidor que no está firmado es pirata o licenciado de forma externa, incluyendo los CDs que haya rippeado. Legalmente están en lo correcto porque incluso cuando se tiene una licencia física en un CD el contenido no le pertenece al consumidor.

Lo que es increíble es el nivel de control que puede tener una compañía sobre lo que hace el consumidor.

1. Si cuando se trata de juegos con precios bajos o difíciles de conseguir, y no cuando se trata de un juego que puedas conseguir en formato físico a un precio similar.
2. No es justo, básicamente te están mintiendo en la cara, ellos saben que no obtendrían tanto dinero si sus botones dijeran "Rentar".
3. Si siempre y cuando el usuario haya hecho algo indebido con el, no porque ya no este disponible en la tienda o el sistema lo dicte, en esos casos deberían reembolsar el dinero gastado, pero como es costumbre las empresas se protegen con los contratos que el usuario aceptó.
4. Trataría de explicarle los riesgos, lo importante que es proteger su cuenta y leer los contratos, aunque esto ultimo dependería del interés de la persona sobre la esto y en el caso de estar en otro idioma seria su entendimiento sobre el lenguaje.
5. "Pedir Permiso".

Personalmente creo que una forma mas segura de conseguir juegos digitales es por medio de aquellas plataformas que prometen ser DRM-FREE, aun así me gustaría alentar a las personas a leer los contratos, para que sepan realmente que están adquiriendo. Esto se debe a que se me dio por leer el EULA de un juego que rente ayer en GOG (creyendo que lo estaba comprando) y que a su vez me llevo a leer el User Agreement.
El EULA en forma muy resumida me dice que el juego no es mio y estoy sujeto a las reglas expuestas en el contrato, si llego a incumplirlo debo destruir cualquier copia del juego que yo haya generado (me pregunto como se dan cuenta sin el DRM ¿sera esto a propósito? :lol: ).
La sección 2.2 en las políticas del User Agreement anticipa diciendo que para acceder al juego es posible que se tenga que aceptar el Contrato de Licenciamiento impuesto por los developers o publishers al momento de pagar o instalar el juego, cabe la posibilidad de que sea el mismo contrato que se debía aceptar en aquel entonces.

Al leer esto pensé que podría aportar al tema y ademas alentarlos a buscar la verdad sobre lo que adquieren, es lo que aprende uno escuchando ScoreVG.

Si a alguien le interesa, el juego que conseguí fue Planescape Torment, es un muy buen juego (aunque se le nota MUCHO los años), es de Interplay y Black Isle creadores de Fallout y Baldur's Gate: https://en.wikipedia.org/wiki/Planescape:_Torment Vale la pena jugarlo si les gusta el genero o si lo toleran, se los recomienda un millennial del 95 :lol: . La version de GOG viene con Soundtrack el cual esta bueno por si lo quieren checar.

Creo que las compañías se dieron cuenta que ya no vender, y mas bien usar el DRM, es una forma de poder generar más ganancias por juegos "retro", y actuales, les permite solventar los gastos (inversión), para poder generar nuevos juegos, porque por lo que sé, son muy caros por eso licencias del Unreal Engine, y tantos remastered de generación pasada. A mí me gustaría llamarlos prestamos.

Hola.
Hace unos días hice una aportación por Twitter y creo que vale la pena extenderla aquí.

En Twitter les decía a Artemio, Rolando y a Pablo que GOG hace poco implementó el servicio GOG Connect que consiste en enlazar tu cuenta de GOG con tu cuenta de Steam y transferir tus títulos de la plataforma de Valve a la de CD Projekt, promoviendo así su plataforma sin DRM. Este servicio está limitado a unos cuantos títulos y cada X tiempo la lista va creciendo. Cabe aclarar que la ventana para pasar tus juegos entre una y otra plataforma es finita, p.e. Ésta semana Limbo llegó a GOG y tienes un par de semanas para aprovechar GOG Connect, después de ese tiempo ya no va a estar disponible para cambiar de plataforma.

Y se preguntarán, ¿cómo es posible esto? (desde el punto de vista legal).
Pues ni GOG y obviamente menos Valve dan detalles, aunque GOG se limita a declarar que "mediante acuerdos de tiempo limitado con los desarrolladores y editores" pueden ofrecer el servicio.
También les decía que les permite pasar una renta de Steam a una licencia sin DRM de GOG y creo que Artemio tiene razón, sigue siendo una renta, pero debido al EULA de GOG las cosas se vuelven un poco grises para quienes no viven en EEUU. Resulta que el EULA de GOG tiene dos variantes ya que son una empresa Chipriota que se rige de acuerdo a las leyes de la UE.

"17.1 You and we agree that your use of GOG services and GOG content and this Agreement will be governed by and interpreted according to the laws of the Republic of Cyprus and that any dispute regarding this Agreement will be heard exclusively by the courts of the Republic of Cyprus. In any legal claim under this Agreement, the side which wins will be entitled to its legal fees and expenses."

Resulta que hay antecedentes legales de disputas de entre varias partes por la reventa de software y que pone en duda la validez legal del esquema de licencias.

Para fines prácticos, las copias de GOG de bienes digitales parecen ser más "tuyos" que las copias de Steam. Con el contenido adquirido en GOG puedes descargar tu copia, respaldarla en un medio físico, trasladarla a cualquier computadora que desees y ejecutar el software sin ningún tipo de verificación, cosa que no sucede con Steam. Ahora, en cuanto a la transferencia de derechos, en teoría los antecedentes de las disputas europeas te darían la razón pero creo que falta mucho para que un ciudadano cualquiera gaste en representación legal para defender su derecho de transferir su propiedad digital a terceros.

Estaba viendo el canal de Franco Escamilla, un comediante (muy chingon por cierto, si no lo conocen se los recomiendo) a quien le gusta el anime y los videojuegos (es uno de los nuestros) compro un xbox one edición especial de gears y se quejo de que no venia el juego en físico, únicamente el codigo de descarga.


Yo pensé que solo nosotros por estar clavados en este tema éramos los que estábamos aferrados en tener el disco en físico, pero al parecer es una situación general.

Todos las compañías y no sólo de videojuegos, siempre se moverán para donde tengan más beneficios económicos, solo unas pocas serán pro usuario y por lo general están destinadas a fracasar, más aún, cuando la mayoría de los usuarios aceptan este tipo de tratos, nosotros somos una minoría que no impacta en forma significativa y no nos escucharan, así que creo que tendremos que acostumbrarnos.
